1. Agreement to Terms
By accessing or using the services provided by Apogee ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Apogee provides legislative intelligence tools including, without limitation:
- Bill tracking and analysis
- Regulatory monitoring
- News monitoring and entity resolution
- Congressional Research Service (CRS) report summarization
- Scheduled briefings, subject workspaces, and drafting tools
- AI-powered research assistants via Model Context Protocol (MCP)
Services are provided via API access, web dashboard, and integrations with third-party AI platforms.
3. User Accounts
To access certain Services, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials and API keys
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
Preview Without an Account: We may let you try the chat interface without registering, through a limited, metered anonymous preview session. These Terms apply to your use of that preview. A preview session is not an account: it is temporary, capped, provided as is, and may be changed, limited, or withdrawn at any time. If you register during a preview, the conversation from that session is transferred into your new account. If you do not register, the session and its conversations are deleted automatically on the schedule described in our Privacy Policy.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Services
- Interfere with or disrupt the Services or servers
- Resell or redistribute the Services without authorization
- Use the Services to generate content that is harmful, fraudulent, or misleading
- Exceed rate limits or abuse API access
5. Intellectual Property
The Services, including all software, content, and documentation, are owned by Apogee and protected by intellectual property laws. You retain ownership of any content you submit to the Services.
We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms and your subscription plan.
License to Your Content: By submitting content to the Services (including messages, uploaded files, and logged notes), you grant Apogee a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit that content as needed to provide, secure, maintain, and improve the Services. You represent that you have the rights necessary to submit the content you provide.
Feedback: If you provide suggestions or feedback about the Services, we may use it to improve the Services without restriction or obligation to you.
6. Data and Privacy
Our collection and use of personal information is governed by our Privacy Policy. By using the Services, you consent to such collection and use.
Session Recording: We use PostHog to record how users navigate our platform. By using the Services, you consent to session recording as described in our Privacy Policy. All chat message content and form inputs are masked and never captured in recordings.
Government Data Sources: Our Services aggregate publicly available government data from sources including Congress.gov, regulations.gov, and public news sources. We do not store or process classified or sensitive government information.
7. Payment Terms
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days notice for monthly plans or at renewal for annual plans.
Free Tiers, Trials, and Credits: We may offer free tiers, trials, or usage credits at our discretion. These carry no entitlement to continued availability and may be modified, limited, or discontinued at any time. Use of the Services is subject to fair-use limits and usage metering under your plan.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue Services with reasonable notice. Scheduled maintenance will be communicated in advance when possible.
Beta and Preview Features: We may make beta or preview features available. Beta features are provided as-is, may change or be withdrawn without notice, and may be excluded from any support or availability commitments.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

You are responsible for your own compliance obligations, including any registration or disclosure requirements that apply to your work.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APOGEE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Apogee and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from content you submit to the Services, your use of the Services in violation of these Terms, or your violation of any law or the rights of a third party.
12. Termination
You may terminate your account at any time. We may terminate or suspend your access for violation of these Terms or for any reason with 30 days notice. Upon termination, your right to use the Services will cease immediately.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
